Open Question: I am the next of kin, there is no will. What to do?
Hello, my brother was a Canadian citizen and has died over three months ago in Texas, USA. He named me as his beneficiary in the will he registered in Canada for his estate in Canada. At that time he only had assets in Canada. After that he moved to Texas, USA for work, and named me as the beneficiary in the company paid life insurance policy. He purchased a house (no mortgage) but died before he had the chance to write a will for that house. I have arrived in Texas recently and do not have a place to stay. I wanted to live in my deceased brother’s house but was told by a lawyer i have met recently that I cannot enter that property. Why? It’s my house anyway, as I am the next of kin. My brother was found deceased in his residence by the police. He died a natural death, there was no crime involved.

The lawyer is telling me that since there was no will, the house will go to the state. But if i pay him a hefty fee, he can get the house transferred to my name. But i don’t have money to pay such heavy fee. I feel he’s not giving me the correct information. Even if there was not will for the house, shouldn’t it go to me, as i I am the next of kin, there is no will. What to do?am the next of kin? What should i do?

Open Question: Does the estate go to the next of kin if there was no will (in Texas, USA)?
The next of kin is mentioned in the previous will registered in Canada. After that the decedent moved to USA, purchased a house, but died before he got the chance to write a will. The next of kin (brother) is also mentioned as beneficiary in the company paid life insurance policy (in USA). The next of kin (brother) has arrived in Texas but does not have a place to stay. Can he enter his deceased brother’s house? No one’s living there. His friends are telling him he cannot enter that house. His brother was found deceased in that house by the police. He had died of natural causes. There was no crime involved. Then why cannot the brother live in that house? It’s mortgage-free.
